I had the opportunity to present at the Institute of Cannabis Research (ICR) Conference at Colorado State University.  The ‘Father of Cannabis’ – the most well known researcher for compounds of cannabis, including CBD (Cannabidiol) – Professor Raphael Mechoulam was the keynote speaker.  Researchers from around the world presented their research and industry experts made contacts to further the understanding and applications of this incredible plant.

My presentation: ’That’s Natural ‘Legal Cannabis’ discussed the moral, ethical, and constitutional ‘legality’ of cannabis use, including:

1. Constitutional ‘legality’ of individuals’ freedom to consume plants for foods and medicine – American’s right to life, liberty, and the pursuit of happiness.

2. 10th Amendment protections for States and individuals when the federal government oversteps its bounds and does not protect individuals’ rights.

3. Representatives ‘Oath of Office’ – meant to protect individuals’ natural and constitutional rights – like the right to consume plants for medicines.

4. Practitioners and doctors ‘Hippocratic Oath’ – meant to protect patients and ensure that healers protect health over motives for personal profit.

5. American’s active participation in creating laws, changing laws, nullifying laws (using the 10th Amendment), and breaking laws is what forms moral and ethical guidelines.

6. Stopping human suffering and helping people to heal is a moral and ethical obligation of all individual citizens but especially those that take an Oath of Office to defend the Constitution and the Hippocratic Oath to protect patients.

The Constitution – even from before its writing and ratification – has been a document that has divided government power to protect and preserve the individual rights of the people.  Individual rights – the right to life, liberty, and the pursuit of happiness – as long as you are not infringing on other peoples’ life or property – are unique among Americans.  American citizens enjoy protections in the Constitution – which is the oldest living paper Constitution in the entire world.

America’s form of government is called a ‘constitutional republic’ although many people refer to it as a ‘democracy’.  A unique feature of the government is the separation of powers in government – in the Legislative, Executive, and Judicial branches of government.  Having these three different parts of government – the part that creates laws (Legislative Branch); the part that enacts and enforces laws (Executive Branch); and the part that interest laws (Judicial Branch) – is what is supposed to protect individual’s natural rights.

There is also a difference between ‘legal rights’ and ‘natural rights’.  “Legal” rights are those that are ‘given’ to you by the government.  “Natural” rights are those that are given to you by your Creator.  I believe that it is a natural (moral and ethical) right to consume plant-based medicines.  Just because something is ‘legal’ – in no way does that make it moral or ethical.  I believe it is moral and ethical to stop human suffering.  Cannabis can help stop human suffering.

At That’s Natural, we refer to this as “Food and Medicine Freedom” – your right to consume foods and medicines that can help heal you or prevent you from getting disease.  Growing your own foods and medicines, and being able to purchase and consume foods and medicines that you choose – we believe – is a natural and ‘God-given’ right.

The Constitution itself says nothing about cannabis – as a matter of fact – that Constitution says nothing about Agriculture, Healthcare, Energy, Social Policy, etc.  Agencies that have been created through laws passed in Congress may be funded by taxpayers – but their functions and actions may not necessarily be Constitutional.  The Constitution is supposed to protect individuals’ life and property.  “Laws” that stop people from being able to access plant-based medicines goes against protecting peoples’ life.  People have a right to be healthy and seek wellness – many government agencies end up interfering in their quest for foods and medicines that can heal them.

Because we have these checks and balances in government at the federal level – it affords Americans the opportunity to change laws that have been created that may have negative consequences for their individual rights.  And, new laws can be created to replace old laws that cannot be changes.  And, worst case – bad laws can be broken using States’ rights.

The 10th Amendment of the Constitution reads:

“The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

When the federal government creates laws that fail to uphold the meaning and intent of the Constitution – State governments can protect their citizens.  Amendment 64 in Colorado effectively did this with the ‘legalization’ of cannabis.  Although this can create a lot of confusion and a ‘gray area’ – ultimately this is protecting individuals’ right to the pursuit of health.  Colorado’s experiment in ‘nullifying’ or ‘ignoring’ federal law is what is giving citizens’ access to new and innovate treatments with cannabis.  Although imperfect, this regulatory framework is proving to be an effective model and is allowing individuals to exercise their Constitutional freedoms.

Our representatives in the Congress and Senate take an ‘Oath of Office’ which reads:

“I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.”

Our representatives are supposed to put our natural and constitutional rights above their personal motives for profit.  Our representatives are charged with protecting us as individuals.

In addition to ‘leaders’ who write laws taking an oath – practitioners and doctors who are charged to help people with their health take the ‘Hippocratic Oath’.  By taking this oath they are swearing themselves to seek help for their patients above and personal motive for profit or gain.  Practitioners and doctors take this oath – and patients trust them to make decisions that are based on compassion – not on profit.

It is a crime that many of the people who create laws and people who write prescriptions are stopping the research and stopping the freedom for people to try and use natural non-psychotropic medicines that can give their body and mind PEACE.  It is against their sworn Oath of Office to protect and defend the Constitution and it is against the Hippocratic Oath taken to protect patients.  It is the citizens’ job to stand up to these unlawful and unethical practices and protect their fellow human beings.  We must hold not only our representatives accountable, but we must also hold doctors and practitioners accountable.  Individuals have a right to use natural, non-psychotropic (does not get you “high”) plants – whether that be hemp, elderberry, or echinacea.
